Official Rules, Terms and Conditions
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS DRAWING. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VALID IN THE STATE OF CALIFORNIA UNLESS PROHIBITED BY LOCAL LAWS. VOID IN ALL OTHER STATES AND COUNTRIES.
Timing: Glendale Water and Power(“Utility”) Peak Savings Program Sweepstakes (this “Sweepstakes”) begins at 12:01 a.m. Pacific Time on February 6, 2023, and ends at 11:59 a.m. Pacific Time on February 24, 2023 (the “Sweepstakes Period”).
Eligibility: This Sweepstakes is open only to natural persons who are legal residents of the state of California residing in Glendale Water and Power Service territory, who are at least eighteen (18) years of age at the time of entry, and who are customers of Glendale Water and Power. Employees of the following companies and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in the same household, whether related or not) are not eligible to participate: Glendale Water and Power and any of its divisions or affiliates, authorized distributors, advertising and promotion agencies, and any other entity that is engaged in the development, production, execution, administration or distribution of this Sweepstakes, including, but not limited to, Franklin Energy Services, LLC (the “Administrator”) and entities supplying the prizes herein. This Sweepstakes is subject to all applicable federal, state and local laws and regulations. This Sweepstakes is void outside the State of California and where prohibited by law. By entering the Sweepstakes as provided in “How To Enter” below, each entrant (“Entrant”): (i) represents that he/she is eligible to participate in the Sweepstakes as provided in these Official Rules and (ii) fully and unconditionally agrees to and accepts these Official Rules and the decisions of Administrator, which are final as to all Sweepstakes-related matters.
How To Enter: Entrants may enter the Sweepstakes through one of the following methods during the Sweepstakes Period:
- Online click or search to fill out the survey completing the survey for the Peak Savings Sweepstakes.
- By phone: 844.323.9083 to call and orally answer survey questions with a customer service representative via phone. Entrants must reference “Peak Savings Sweepstakes.
Only one entry per household will be eligible. Incorrect, partial or late entries will not be accepted.
A purchase or payment of any kind WILL NOT increase your chances of winning.
The Utility and Administrator reserve the right to disqualify any household or email address with multiple entries. Any submission of robotic, automatic, mechanically reproduced, or programmed entries or any entries submitted by agencies, other third parties, or through other unapproved methods are void.
Utility and Administrator will not confirm receipt of entries for Entrants. All submitted entries become the sole property of Administrator and will not be returned.
Winning: On or about (2) prize winners (the “Prize Winners”) will be selected in a random drawing conducted from among all eligible entries received during the Sweepstakes Period. The random drawing will be conducted by the Administrator. Administrator’s decisions and interpretation of these Official Rules will be made in Administrator’s sole discretion, and Administrator’s decisions are final as to all Sweepstakes-related matters. Odds of being selected as the Prize Winner will depend upon the total number of eligible entries received during the Sweepstakes Period.
Notification: Administrator will notify the Prize Winners by phone or email on or about three (3) business days after the random drawing date and after the Prize Winner’s eligibility is verified by Administrator. Administrator will pay for shipping and handling charges for the prize. In the event a prize is returned as undeliverable, such Prize Winner will be disqualified and an alternate Prize Winner will be selected at random from amongst all remaining non-winning eligible entries received during the Sweepstakes Period. Neither the Utility nor the Administrator is responsible for undeliverable prize notifications due to any change in a potential Prize Winner's phone number, email address, or mailing address.
Prize: The following prizes will be awarded for the Glendale Water and Power Holiday Sweepstakes Period.
Grand Prizes: Two (2) Grand Prizes of a $250 Visa Gift Card will be awarded (the “Grand Prizes”). The approximate retail value (“ARV”) of the Grand Prize is $250.00.
The total ARV of all prizes to be awarded in this Sweepstakes is $500.00. No prize substitution, exchange or cash redemption of any prize shall be permitted, except at the sole discretion of the Utility. Prizes are not transferable prior to award. Administrator reserves the right to substitute a prize of equal or greater value for any prize, should the prize become unavailable due to reasons beyond the control of the Administrator. The prize must be accepted “as is,” and no warranties will be provided by the Utility or Administrator. Names of prize manufacturers/trademark owners are used solely for the purpose of identification of the prize. No endorsement, authorization, sponsorship, or approval by prize manufacturers is intended or implied by such use. Visa is not affiliated in any way with Glendale Water and Power or the Administrator and is not a sponsor of this Sweepstakes. The Prize Winner is solely responsible for all applicable federal, state and local taxes associated with the prize. Limit of one (1) prize per person/household during the Sweepstakes Period. No more than the number of prizes set forth in these Official Rules will be awarded. All prizes will be awarded.
Publicity: Except where prohibited, the Prize Winner consents to the use of his/her name, likeness, voice, photograph, testimonials, statements, opinions, biographical information, hometown and state in advertising worldwide for promotional and publicity purposes in any media, including social media, without further payment, consideration, notification or limitation.
General Conditions: Sweepstakes is subject to all applicable federal, state and local laws. By participating, Entrants and the Prize Winner agrees to comply with, and be bound by, these Official Rules and the decisions of the Utility and Administrator (including, but not limited to, eligibility determinations) and waive any right to claim ambiguity in this Sweepstakes or these Official Rules. Should any portion of the Sweepstakes be, in Administrator’s sole discretion, compromised due to non-authorized human intervention or other causes which, in the sole discretion of the Administrator, corrupt or impair the administration, security, fairness or proper play, or submission of entries, if permitted by applicable law, Administrator reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. In such event, Administrator reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Administrator reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. ADMINISTRATOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.
Release: By participating in this Sweepstakes, Entrant agrees to release and hold harmless Utility, and each of their respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, distributors, advertising, promotion, and fulfillment agencies, including Administrator, consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, redemption or use of any prize.
Limitations of Liability; Governing Law: The Released Parties are not responsible for: (a) unauthorized human intervention in any part of the entry process or as it pertains to the Sweepstakes; (b) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; (c) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Sweepstakes; (d) any printing or typographical errors in any Sweepstakes-related materials; and (e) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software. In addition, Entrant agrees that (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any Prize shall be resolved individually, without resort to any form of class action, solely and exclusively in a federal or state court located in the State of California and Entrant submits to sole and exclusive personal jurisdiction to said courts in the State of California for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, if any, in entering the Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforce-ability of these Official Rules, or the rights and obligations of Entrant in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of California the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
Entrants’ Personal Information: Information collected from Entrants is subject to the privacy policy of Glendale Water and Power, which is accessible at the following url Policies | City of Glendale, CA (glendaleca.gov) By participating in the Sweepstakes, Entrant acknowledges that Entrant has read and accepted Utility’s privacy policy. Participation in this Sweepstakes constitutes Entrant's consent to disclosure by the Administrator of the name and address associated with the Entrant's winning entry, if any, to the Utility and any other merchant or service provider involved with administering this Sweepstakes, or preparing or delivering any prize. Moreover, the Utility and Administrator reserve the right to use the Prize Winner’s first name and first surname initial with their general location (city and state) in social media or announcements regarding the winner of the Sweepstakes and to retain such information if required by law.

Winner's List/Rules Request: For the names of the Prize Winner or a copy of these Official Rules, please submit a self-addressed, stamped envelope to “Glendale Water and Power 2023 Peak Savings Sweepstakes,” 141 N. Glendale Ave, Suite 114A Glendale, CA 91206. Specify “Winners List” and/or “Rules Request” on the outside of the envelope. A copy of these Official Rules may also be obtained at the website during the Sweepstakes Period.
